Asylum & Immigration

Every business engaging with temporary workers/contractors must check an individual's right to work in the UK.

Should you fail to do so and the worker does not have the right to work in the UK, a potential unlimited fine can be imposed on your organisation and potentially an action personally against the individual who placed that worker.

There are numerous types of visa and work permit stamps - not all of which allow migrant workers to work in the UK. We know which stamps allow individuals to legitimately work and those which do not.

We know by looking at an individual's passport whether they have the right to work in the UK.

Conduct of Employment Agencies and Employment Businesses Regulations

These Regulations (also know as the EAA Regulations or Conduct Regulations) were implemented by the Government in 2003 and it significantly changed the operating and commercial nature of employment agencies and employment business. For example, unless the employment business provides the client with an “option to extend” the assignment of a worker, the employment business will be unable to impose introduction/transfer fees. The transfer fee rules are different for limited company contractors who “opt out” from the Regulations.

There are numerous different obligations with which agencies must comply.

Without scaremongering, the Government has the right to impose penalties and potentially close down businesses who do not comply with the Regulations.
